A Magistrate Court sitting in Makurdi, Benue State, on Thursday denied a serving councilor, James Aondover Semail, and five others bail over alleged killing of a 45-year-old man.
The serving councillor and the five persons are facing case of culpable homicide of one Michael Iormbaamo Iorchir of Dzev kindred in Shangev-Ya district in Kwande Local Government Area of the state.
The accused were said to have, on 14th of June, 2017, invaded the deceased’s residence, forcefully abducted him, heinously killed him and then abandoned his body in the bush close to their area.
The other five accused persons are: a former Supervisory Councilor in the local council, Mr. Akuha Shimaibo; Terzungwe Bem, Terwase Aloho, Tersoor Dura, and Asom Tyongi, all of Mbakyaa kindred in Shangev-ya district of the local government.
Consequent upon the death of Iorchir, the younger brother, Aondowase Iorchir, had, on the 19th of June, 2017 reported the matter to the Police Zonal Command, Gboko, which swung into action and arrested the suspects.
The presiding Magistrate, Mrs. Igyama A.R., who ruled on the motions for bail in respect of the six accused, told their counsels that the court lacked jurisdiction to grant the accused bail since it’s a case of culpable homicide and of capital offense in nature.
Mrs. Igyama added in the ruling that, after all, a statement of eye witness account had been placed before the court to persuade her to refuse the application for bail in the interest of justice.
